The Augsburg Research Centre of European and American Law (AREA) under the direction of Professor Dr. Thomas M.J. M?llers is a centre for the cooperation of American and German academics within a legal context.
Especially in the area of law enforcement, US-American law is ahead of German or national law. Keywords such as "punitive damages" and "deep pocket doctrine" are commonplace in the US legal system and ensure that the law is followed.
Research
The current Volkswagen scandal clearly shows how interwoven our markets are. Globalization poses the challenge to legal science that despite sometimes considerable differences in the various legal systems, it must be ensured that customers of the same company are not put at a disadvantage by the fact that they are subject to a different legal system that provides less effective law enforcement mechanisms.

New publication: M?llers, Auditors report and the German Capital Markets Model Case Act (KapMuG) - legal consequences for EY in the Wirecard scandal

In Volume 19 of the Capital Markets Law Journal (CMLJ) Professor M?llers' article "Auditors report and the German Capital Markets Model Case Act (KapMuG) - legal consequences for EY in the Wirecard scandal" deals with the accounting fraud and ensuing insolvency of Wirecard which have had an enormous impact. Claims from aggrieved investors are now before the courts. As the listed company is insolvent, many claims have instead been lodged against its auditors, EY. Within this framework, the cases should be joined together where possible. Several Regional Courts have rejected the material scope of application of the Capital Markets Model Case Act (KapMuG), but the Third Chamber of the Regional Court of Munich I (LG) has opened proceedings under the Act. This requires the auditors report on the company's annual financial statements to qualify as “public capital market information” pursuant to Section 1(2) of the Act. Because the issue has not yet been discussed, arguments created by legal reasoning must be used to clarify whether claims for damages against the auditors report can be made the establishment objective of proceedings under the Act.

On Friday, November 17, the graduates of the 2022/2023 class of the Munich Intellectual Property Law Center (MIPLC) received their Master of Laws (LL.M.) as part of the 20th graduation ceremony.

Lecture ?Gazing into World Society: A System-Based Approach to Global Governance“

In cooperation with the DAJV in Augsburg, Professor Sungjoon Cho gave a lecture on "Gazing into World Society: A System-Based Approach to Global Governance" on November 7 at 7:00 pm. The lecture dealt with the application of Niklas Luhmann's systems theory to current global developments such as economic decoupling and economic sanctions and was commented on by Dr. Cayle Lupton (新万博体育下载_万博体育app【投注官网】 of Johannesburg). This was followed by a panel discussion.
Sungjoon Cho has been a professor at Chicago-Kent College of Law (Illinois Institute of Technology) since 2003 and has already negotiated before the World Trade Organization (WTO) and the Organization for Economic Cooperation and Development (OECD) as a representative of the government of the Republic of Korea.
